Bets; Compliance | For Sports Betting Operators: Brazilian Ministry of Finance Prohibits Betting by Bolsa Família and BPC Beneficiaries – Understand in 3 Key Points What Changes for Your Compliance and Operations


On October 1, 2025, the Brazilian Ministry of Finance’s Secretariat of Prizes and Betting (SPA/MF) published Normative Instruction No. 22/2025 and Ordinance SPA/MF No. 2,217/2025, which expressly prohibit beneficiaries of the Bolsa Família Program and the Continuous Benefit Program (BPC) from participating in fixed-odds betting.

These measures fulfill precautionary decisions of the Brazilian Supreme Court (ADIs 7721 and 7723) and recommendations from the Federal Court of Accounts.

1. Mandatory account blocking at registration and login: Betting operators must consult the Betting Management System (Sigap) both at account registration and at every user’s first daily login. If the user is flagged as ineligible due to receiving social program benefits, registration must be refused or the account closed within 3 days. The user must be notified and given 2 days to withdraw any funds, after which remaining balances are automatically transferred to the user’s bank account.

2. Regular verification and reversal of funds: Operators are required to review their entire user base every 15 days to identify new social program beneficiaries and must check all registered CPFs within 45 days. Funds not withdrawn within 180 days will be transferred to the Student Financing Fund (Fies) and the National Fund for Public Calamities, Civil Protection and Defense (Funcap).
 
3. Strict sanctions for non-compliance: Failure to comply with these new rules subjects betting operators to penalties as set out in Law 14,790/2023 and in Ministry ordinances, including warnings, fines, and even revocation of the authorization to operate. Ordinance No. 2,217/2025 also provides for additional regulation regarding timelines, monitoring, and oversight of these requirements.
 
Therefore, it is essential to implement robust technological controls and compliance procedures to exclude Bolsa Família and BPC beneficiaries from fixed-odds betting, under risk of significant administrative and financial sanctions.
