On September 19, 2025, Normative Instruction SEGES/MGI No. 382/2025 was published, establishing, for the purposes of tiebreaker criteria in bidding processes, the application by companies of equity actions between women and men in the workplace.
These practices include measures for equal professional insertion and advancement, equal pay, prevention of moral and sexual harassment, promotion of health and safety at work with a gender focus, among others.
Proof of the development of equity actions must be provided through specific documents and evidence, leading to the classification of companies into three levels: gold, silver and bronze.The procedures for verification involve the presentation of certification seals, reports, internal standards, adherence to commitments and dissemination of policies related to the topic.
For companies, the lack of preparation or adequate documentation can represent a loss of competitiveness even with economically advantageous proposals. This reinforces the need to invest in internal governance, transparency, and consistent corporate policies to maintain relevance in public procurement.
Given this scenario, four points of attention stand out:
1. Map internal gender equality policies and practices, including compensation indicators and career plans.
2. Verify whether documentary evidence (internal standards, reports, certifications) meets the criteria of the levels defined by the standard.
3. Ensure the authenticity and validity of seals and certifications used as proof.
4. Mitigate risks of inconsistencies that could compromise the qualification or use of the tiebreaker criterion.
This new provision for bidding is aligned with ESG practices and the UN’s 2030 Agenda for Sustainable Development. Companies that anticipate, review their internal policies, update documents, and implement best practices, will be better positioned to compete on equal terms and gain strategic advantages. In an increasingly strict regulatory environment, being prepared is more than an obligation, it is an opportunity to differentiate yourself in the market.
